A

intentional killing of a person with malice aforethought. Malice aforethought requires the killing be committed with one of the following states of mind: 1. intent to kill 2. intent to commit great bodily injury 3. wanton and willful disregard of human life or 4. intent to commit a felony.

What is 5th Am. right against self-incrimination?

A

Police must give Miranda warnings before interrogating a person in custody. Custody means a person is not objectively free to terminate the encounter with the government, i.e., she does not reasonably believe she is free to leave. An interrogation is any conduct that police know or should know is likely to elicit an incriminating response. Miranda warnings inform defendant of rights to remain silent and to an attorney. Waiver of rights is only valid if given knowingly, voluntarily and intelligently.
