Solicitation
Requires: 1) encouraging another to commit a crime; 2) with the specific intent that the solicited person commit the crime. If the person commits the crime solicited, both parties may be convicted of the crime. Affirmative response is not required.
Under the merger doctrine, the solicitation merges with the committed crime.
No defense that the solicitor renounced the or withdrew the solicitation. He must actually prevent the commission of the crime for withdrawal to be valid.
Accomplice
One who, with the intent that the crime be committed, Aids, Counsels, or Encourages the principal to commit the illegal conduct. Accomplice is liable for the underlying crime and all other foreseeable crimes to the same extent as the principal.
