What is classed as physical abuse in the CPP context.
Non accidental injury.
What are the three areas to be considered in determining whether physical abuse meets the threshold for referral as a CPP case.
The action (of the abuse) The injury inflicted (Outcome or result The circumstances (factors in the case)
What situations would meet the threshold for a referral immediately?
Any of these actions: Blow or kick to the head Shaking (of an infant) Stangulation Use of an object as a weapon Attempted drowning OR Any of these injuries: A bone fracture Burn Concussion or loss of consciousness Any injury that requires medical attention ANy burising or abrasion when the child is very young.
Other cases such as hitting, kicking and slapping in combination with what other things could result in a CPP referral?
The vulnerability of the chld, more than one offender, history of abuse, high degree of violence, the offenders history or background.
What are the 3 initial steps that CYF and Police must follow?
- Referral - information sharing between the 2 agencies.
- Consultation - discussion at appropriate levels.
- Agreement - agreeing upon an initial action in an Initial joint investigation plan (ijip).
What things must an Initial joint action plan consider?
The immediate safety of the child involved and any other children who may be identified as being at risk.
Referral to a medical practitioner and authority to do so.
The management of the initial interviw with the child.
If a joint visit i required due to risk of further offending, loss of evidence, the alleged offender is likely to be hostile, any concerns for staff safety.
Collection of any physical evidence such as photographs.
Any further actions agreed.
When would you question a child as to what has happened to them?
If it is absolutely necessary to speak to them to ascertain safety, ask open ended questions and do not continue to question the child if it becomes clear while speaking to them that an offence has occurred.
The enhanced victim right act 2014 section 4(a)(iii) expands the definition of a victim to also include who?
A person against whom an offence is committed by another person.
A parent or legal guardian of a child or of a young person who falls within the above paragraph.
How can you complete a CPP referral?
By completing a Pol 350 through Police mobility.
By completing a Pol 350 and emailing it to Oranga Tamariki.
By calling Oranga Tamariki and making a verbal referral over the phone.
