what is a real convenant?
a written promise to do something or refrain from doing something on land
what are the requirements for the burden to run re: a real covenant?
- intent
- notice - a subsequent purchaser for VALUE must have had actual notice at the time of purchase
- horizontal privity - some relationship b/t the parties besides the covenant, i.e. mortgagor-mortgagee, transferor-transferee
- vertical privity – to be bound, the successor in interest to the covenanting party must hold the ENTIRE DURATIONAL INTEREST held by the covenantor at the time the covenant was made
- touch and concern the land
what are the requirements for the benefit to run re: a real covenant?
- intent

how do you terminate a real covenant?
(obvi, not meet the requirements to begin with)
- written release
- the merger of the benefited and burdened estates
- the condemantion of the burdened property
what is an equitable servitude?
a covenant IN WRITING that equity will enforce against hte assignees of the burdened land who have notice of the covenant; usual remedy is an injunction
what is a negative equitable servitude?
such as common scheme for development
when is a negative servitude implied?
only implied if, at the time that sales in the sbudivision began, the developer had a plan that all parcels would be subject to the restriction.
- recorded plat
- general pattern of restrictions; or
- oral representaitions to early buyers
re: equitable servitude, what is req’d for burden to run?
- intent - covenanting parties intended that the servitude be enforceable by and against assignees;
- the successor of the promisor has ACTUAL, INQUIRY, OR RECORD notice of the servitude;
- the covenant touches nd concerns the land

equitable defenses to enforcement of an equitable servitude:
- unclean hands - person seeking enforcement is violating a similar restriction on his own land
- benefited party acquisced in violated of the servitude
- estoppel
- benefitted party fails to bring suit against violator w/i a R time – laches
- neighborhood has changed so significantly that enforcemnt would be inequitable
