The issue of jurisdiction can be raised at any time/stage of the proceedings even on appeal for the very first time because it is fundamental as it relates to the root of the case and when it is raised, the court must stop and hear it.

However, on appeal, the leave of the court must be sought and obtained to raise the issue of jurisdiction.

Section 280 (1) of the 1999 Constitution
provides that there shall be for any state that requires it a Customary Court of Appeal. It consists of a President and such number of Judges as may be prescribed by the House of Assembly of a State.
