Court and Judicial authorizations Flashcards
Routine Police Evidence
Section 657.01 would allow the Crown to call a police officer’s evidence by affidavit.
The person on trial would have to give notice of intent to object to the procedure and/or request the attendance of the witness for cross-examination.
- This should stream line trials where all officers who had a hand in the investigation where sometimes called to appear in person, and not called as a witness in the end.
Judicial Authorizations
Numerous Judicial Authorizations and Orders that once needed to be “backed” or “endorsed” for another province, now have effect throughout Canada.
Production Orders were already across Canada resulting from Bill C-13, wording change only.
Blood Warrants, Firearm warrants, and some other rare ones (gambling, voyeurism) you could never get backed, still cant.
Does away with process of having to do CROPS to CROPS requests between divisions and having resources tasked with having Judicial Authorizations endorsed.
