A
- Both AR and MR need to be present at the same time for an offence to take place
- In reality AR and MR don’t always coincide

- Provided while the AR is still going on, D forms an MR, then they are said to coincide

- D realised then refused to move the car (MR formed)
- AR treated as a continuing act

- Still said to coincide
