What is protected under this act?

A

Any unauthorised copying of all or any substantial part of any original work.

  • “substantial”- quality as well as quantity
  • “original”- using some element of ‘skill, labour + judgment’

Who owns copyright?

A

Before August 1st 1989: Copyright is owned by whoever commissioned the work
Since August 1st 1989: Generally the author or creator is the first owner. For staff the employer owns the copyright. Even if a piece of work has been commissioned it is still the first owner unless it has been reassigned
