What are an architects rights in terms of copyright?
Intellectual property copyright is the default right of the architect (unless otherwise agreed)
The client has an express licence to use the design only on the site sit in intended for
If the licence is to be transferred when site is sold the architect must give written permission
An architects plans etc cannot be used by another architect without their written permission
An architect can withhold the licence if fees have not been paid
If all fees are paid then the licence for the site in unrevokable
Does the alteration of a building breach and Architect’s moral rights or copyright?
Moral rights will not prevent a building from being altered
without the architect’s consent, but it does require the owner to notify the architect before
the alterations or demolition take place
Who owns the copyright on crown projects
If the client is the Commonwealth, state or territory government (or their agency) and the
copyright material is prepared under that government’s direction or control, the government
client will automatically own copyright in that copyright material
