(e) observation of private activity in the curtilage of private premises, and any recording of that observation, if any part of the observation or recording is by means of a visual surveillance device, and the duration of the observation, for the purposes of a single investigation, or a connected series of investigations, exceeds— (i) 3 hours in any 24-hour period; or (ii) 8 hours in total.
What should be profiled about the package?
The sender details eg;
- phone numbers
- DNA
- Fingerprints
- Handwriting
- impressions
- multiple packages and dummy runs to target address
What is the benefit of a clean controlled delivery?
It eliminates any risk of the drugs being lost and gives greater freedom for organising surveillance and reduces risk of alerting targets.
What should the OC Exhibits do early in the controlled delivery investigation
Liaise with customs and take control of exhibits where necessary. The ultimate responsibility that this is done correct rests with Police
When can an electronic interception phase be used during a controlled delivery?
Where the drugs are Class A, B or a cannabis offence under S6 MODA 1975.
What should be considered in relation to the recipient?

Where a customs officer has exercised their powers under S12 of the Misuse of Drugs Amendment Act 1978, a constable or customs officer can search without warrant

What is the difference in relation to the two delivery options of a controlled delivery?
A clean delivery means you can only charge with importing and conspiracy where as the second option allows for the option of charging with possession for supply as well.
Under the second option emergency powers can also be used in case the consignment is moved to another place or vehicle where there is now warrant.
What must be included in the surveillance device warrant?
Name, address or other description of the person, place, vehicle or other thing that is the subject of the proposed warrant
What action should be taken when repackaging a controlled delivery package?
- Liaise with customs technical unit
- Consider your options for repackaging
- Consider seeking advice from a document examiner in relation to recreating packaging
- leave appropriate amount of drug inside and replace rest with placebo
- photograph package layer by layer and use a scale rule and photo labels
