Rule for damages in breach of contract
The ordinary measure of damages in a breach of contract action is expectation damages, which aim to put the nonbreaching party in the position he expected to be but for the breach. Expectation damages must be foreseeable and proved with reasonable certainty.
Rule for punitive damages in breach of contract
Punitive damages are not generally recoverable as an element of damages in a breach of contract action unless the breach is also a tort for which punitive damages are recoverable.
