Offer, acceptance, consideration, capacity, intention and legality.
What are Contract Particulars?
Aspects of the Contract that are bespoke to the project i.e completion date, date of possession, defects rectification period and LD’s
What are the Recitals under a JCT contract?
They set and overview of the project, including brief description of the works.
What are the Articles under a JCT contract?
Identify primary obligations of the parties under the contract.
What is Attestation?
Process of confirmation, under seal and under hand.
What is an LOI?
Indicates one parties intention to enter into a formal contract with another, typically asking for works to start before formal contract is executed.
What info is typically in an LOI?
-Detailed description of works
-Contract Sun (if it is agreed)
-Date of possession
-Date for completion
-Insurances
-Method of payment
-Employers right to not enter main contract
What is a PCSA?
Pre-Construction Services Agreement
What are typical PCSA services?
-Contribution to design
-Advice on buildability, sequencing and risk
-Advise on selection of subbies
-Help develop cost plan and programme
