How is liability for defective products established under the Consumer Protection Act?
A
If the producrt is defective because its safety was not such as persons generally are entitled to expect, then a producer will be liable if the Claimant suffered damage caused by the defect in the product.
Liability under the CPA is strict; it is not necessary to prove that the defect was caused by any fault on the part of the Defendant.
If you can’t find the manufacturer/producer, supplier can be liable in a exceptional circumstances
