The Eleventh Amendment
A
prohibits private individuals from suing states for money damages in federal court without their consent, subject to the following exceptions:
- federal suits against sister states or suits brought by the federal government against a state
- lawsuits against subdivisions, towns, cities (no immunity)
- most lawsuits for injunctions
- the state consents
- suits against state officials for abusing their power and enforcing thei
The 11 the Amendment recognizes the states and their governmental immunity.
