What is libel?
a published false statement about somebody and damages there reputation;written down
What is slander?
An action or crime of making a false statement about someone that damages there reputation;spoken
What is Federal Supremacy?
the Federal Government, in exercising and of the powers enumerated in the Constitution, must prevail over any conflict or inconsistency state exercise of power
What is probable cause?
reasonable ground, reason to believe
What are the three things needed for a warrant?
- filed in good faith from law enforcement
- probable cause, reliable info
- issued by a neutral source
- must state specifically where and what they are looking for
What is double jeopardy?
the prosecution of someone twice for the same offense
What is eminent domain?
the right of the government to take away private property for public use if the owner is paid
What is quartering?
housing troops
What is civil vs criminal case?
Civil: when one person (the plaintiff) asks the court to require the defendant to fulfill some duty owed by the plaintiff
Criminal: when someone has been formally charged and indicted of a felony
What is a bail/bound?
paying an amount of money based on a crime in order to be released as long as the defendant shows up in court
What is a seizure?
when something or someone involved in a criminal case has been forcefully taken
What is the grand jury?
a jury with 23 people selected to determine the validity of an accusation
what is the “Burden of proof”
the obligation to prove one’s allegation
what is the establishment clause?
congress can’t make laws against religion
what is the free exercise clause?
congress can’t violate people’s right to practice there religion
