So long as such a design rests in intention only it is not indictable. When two agree to carry out the offence the very plot is an act in itself

A

Anything a conspirator or party of says or does to further the common purpose is admissible against the others involved.

But does not include explanations made after the common purpose is carried out. That is only against the person who made those explanations

  • should not lay conspiracy charge if the substantive offence can be proved because:
  • the evidence may be prejudicial to the other charges
  • complicate and prolong trial
  • may be squashed if not even evidence
  • severance may be ordered - each charge heard seperatly
