What are the elements required for consent to treatment in a non-emergency situation
Given by a person who is capable of giving consent with respect to the treatment plan
consent must relate to treatment plan
consent must be informed
consent must be given voluntarily
consent must not be given through misrepresentation or fraud
When is consent to a treatment plan informed?
Patient has been given information that a reasonable person in the same circumstances would require in order to make a decision about the treatment
What information should a patient be given to give informed consent
nature of treatment
expected benefits of the treatment
material risks of treatment
material side effects of treatment
alternative course of action
likely consequences of not having treatment
If a patient requests additional information is the paramedic required to give it?
yes, additional information needs to be given when requested
What makes a patient capable, with respect to a treatment plan?
able to understand information given
able to appreciate reasonably foreseeable consequences of a decision or lack of decision
What if a patient is incapable of consenting to a proposed treatment?
If the paramedic is made aware of wishes made by patient when they were capable, they are to honour that wish in regard to the proposed treatment (ie DNR)
