What is gillick competence/fraser guidelines?
When a person age 12-15 can give consent to treatment/diagnostic interventions IF they have reached sufficient understanding and intelligence to make their own decision.
However they cannot refuse treatment even if gillick competent - parents will make choice in their best interest.
If not gillick comptent then parents have to make decision in patients best interest.
When can child give consent?
Once they reach age 16 can give consent regarding any medical or surgical treatment. No parents necessary
If refuses consent then parents can give consent to treatment in child’s best interest.
If parents refuse treatment?
If doctor thinks strongly its in childs best interests, then can involve courts (specific issue order)
Law behind abortion
2 registered practitioners must agree to decision
Cant exceed 24th week and if allowed to carry on it would:
- cause physical or mental injury to the mother or future child
- cause grave permanent damage to physical/mental health of mother
Under law in england, scotland and wales can be terminated at any time if risk that child would suffer so gravely it would be handicapped.
If doctor belives that termination is needed immediately to prevent grave injury to woman then doesnt need second opinion.
