Contradictory cases of sado-masochism between heterosexual (success) and homosexuality (fail)
Law is very confusing as what is / isn’t allowed
Law applied differently which opposes rule of law

Harm in sport

A

What is inside the scope of the game especially as some harm is intentional
This can lead to confusion in the law as punching someone in football breaks the law but someone in boxing would be expected to punch their opponent
This then leads to the law becoming extremely inconsistent and unfair

A

Able to use consent as a defence when v did not due to ‘genuine belief’
Could be seen as unfair and favouring the defendant rather the victim which is not the point of the law
This is unfair to the victim who may have been harmed and could lead to inconsistencies as to what is or isn’t consent

A

The law is extremely clear in regards to medical procedures because of clear regulations of what is or isn’t a criminal act
Allows doctors to preform vital surgery’s legally to save lives due to the understanding of the law (rule of law)
