Consent Flashcards
What is informed consent/Opt-In system
You must inform the government that you wish to donate your organs
Your organs cannot be used if you don’t Opt-In
What is presumed Consent/the opt-out system?
Your organs will be donated unless you tell the government otherwise
What is Hard Presumed?
Your family cannot say you didn’t want your organs donated after death, your organs will be used anyway
What is soft presumed?
Your family can say that you didn’t want your organs donated after death and their wishes will be respected
What are the moral issues raised by consent?
Medical Integrity
Giving
Vulnerable in Society
Supply
Human Rights
Personal Autonomy
What is the issue of medical integrity?
If every patient is a donor doctors may start seeing them as just spare parts
What is the issue of Giving?
In a presumed consent system the option to give is taken away as you’re not actively giving your organs you’re just not objecting to having them removed
What is the issue of Vulnerable in Society
Vulnerable people such as children and those with mental disabilities might not understand changes in law or that they need to tell the government they don’t want their organs taken
What is the issue of Supply?
A change to a presumed consent system would increase organ supply however it doesn’t always work because in some countries they don’t have the systems to keep track
What us the issue if human rights?
Both systems violate the right to privacy as you have to declare your stance on organ donation
Not consenting to being a donor may deny others the right to life and rights to medical care
What is the issue of personal autonomy?
Changing from an informed to presumed consent system limits your autonomy because the choice is being made for you
People may be forced to make a choice they didn’t have to before
What is The Church of scotlands response in favour of presumed consent?
“It would be immoral not to do everything ethical to prolong and improve the quality of lives of those in need of a transplant” presumed consent system ups the supply
What is the church of scotland’s response against presumed consent?
“Such a change could discriminate against groups who might not be aware of any change, through lack of knowledge or understanding”- vulnerable in society
What is Hinduism’s response to consent?
“That which sustains life should be accepted and promoted as Dharma” - issue of giving, they cannot complete Dharma if they don’t actively give organs
What is the British Medical Association’s response to consent?
“We believe this is the best possible option to reduce the shortage of organs and save lives”-supply
