What is the Commerce Clause

A

Article 1 Sec 8, Clause 3 - The Commerce Clause of the Constitution gives congress the power to regulate commerce among the states and, by negative implication, restricts the regulatory power of the states with respect to interstate commerce.

No Protectionist law (a state law that discriminates against interstate commerce) unless it serves a legitimate local interest that cannot be served by nondiscriminatory legislation.

A

The Supreme Court has held that the federal government cannot force a state government to take an action that it would otherwise not take. - including fed require state to enforce statutes.
