Transfer of Rights From Parents to Students
All students, including those with disabilities
-If a student cannot, there is a legal guardian of the student
Educational Rights of Students with Disabilities Over 18
Right to know what disability they have and how it affects their abilities
-Right to an IEP meeting and to participate, and bring whoever they want
-Right to accommodations and related services

Permission slips, waivers and releases do not work if teachers do not perform duties appropriately

Child Neglect and Abuse
1996 Child Abuse Prevention and Treatment Act (CAPTA)
-Physical
-Sexual
-Emotional
-Neglect
-Teachers/School staff are mandatory reporters of suspected abuse
-Tell administrator, document as much as possible, interview with open-ended questions
Abuse Definition
Any recent failure to act, or action, resulting in imminent danger of death, serious physical or emotional or other harm, sexual abuse or exploitation of a child younger than 18 years by a parents, teacher, babysitter or caregiver responsible for the child’s welfare
Sexual Abuse Definition
-Using, enticing, persuading, employing, inducing or coercing any child to engage or help anybody engage in sexually explicit conduct or simulation thereof to produce any visual depiction of it
-Incest, rape, statutory rape, molestation, prostitution or any sexual exploitation of children
Emotional Abuse Definition
Any sustained, repeated behavior pattern(s) demonstrable impairing a child’s sense of self-worth or emotional development
-Includes withholding guidance, support or love, confinement, rejection, threats and constant criticism
Neglect Definition
-Failing to provide for a child’s base needs
-Includes necessary shelter, food, medical care and supervision
-Neglecting education needs of emotional needs
-Excessive corporal punishment
Parental Rights
Request a school evaluation and a more appropriate placement, school of choice if public school fails
-Confidentiality of student records
-Review records and disciplinary action
-School information in native language and interpreters/translators for PTC
-All children in America can attend public school regardless of immigration status
Response to Repeated Parent Question at an Open House
Set limits
-Talk after the presentation
School Compliance with Federal Regulations
-Notifying of no discrimination
-Informing who to go to for complaints and information
Response to Parent Question Curriculum and Instructional Method
-Avoid being defensive
-Have copies of state standards, teacher editions and information for parents to read
-Explain methods

Response to Disruptive Student Behavior
Pushing undesired behavior works less than rewarding desired behavior
-Don’t punish disruptive or unpredictable behavior
