- Illicit drugs or alcohol intoxication, Excited Delirium or use of some prescription drugs.

Process for a refusal to work because of unsafe work conditions
CLC 128
Step 1: the employer investigates.
Step 2: if it still isn’t resolved then the unresolved complaint may be referred to a chairperson of the work place committee or the health and safety officer for further investigation
Step 3: the health and safety officer on completion of their investigation will give written notification of the decision to the employer and employee
Step 4: the Warden may then ask the employee to return to work. If the employee still believes that danger exists regardless of the findings of the health and safety officer then the issue will be referred to the ESDC. Any employee that is asked to work in this area must be fully informed of what has occurred and the findings of the investigations.
