Define ‘mental disorder’
An abnormal state of mind (whether continuous or intermittent nature) characterised by delusions, or disorders of mood, perception, volition or cognition to such a degree that:
poses a serious danger to the health or safety of themselves or others, or
serious diminished capacity to look after themself
what is a restricted patient
a person who is subject to a compulsory treatment order but are considered to be a danger to the public
what is a special patient
a person who has been detained by a court order if they have been found criminally insane, or unfit to plead.
includes people on remand for psychiatric report
Compulsory Treatment Order patient
In patient - stays in pyschiatric unit for treatment
Out patient - lives at home and attends psychiatric unit for treatment
when patient absent without leave …
Special or restricted patient:
may be apprehended and returned to hospital at any time
Compulsory Treatment patients:
returned to hospital if apprehended within 3 months of going missing
What is sec 109 of Mental Health Act 1992?
Police Powers in Relation to Mentally Disordered People in Public Places
Any memebers of police may apprehend
Any person wandering at large in a public place
AND
Behaving in a manner that gives rise to a reasonable belief that he/she may be mentally disordered
AND
The member believes it is in the interest of the person or the public to do so
What is sec 41 of Mental Health Act 1992?
Assisting a Duly Authorised Officer
A DAO may call for assistance from police so they can assess or transport a patient
Any member of police called upon in such circumstances may
Enter the premises by force if neccessary
AND
Detain the person on those premises until the assessment examination has been conducted
OR
Take the person to some other place nominated by the DAO for the purposes of medical examination or assessment and detain at the location until the examination has been completed
What is sec 110C of Mental Health Act 1992?
Assisting a Medical Practioner

What is sec 122B of Mental Health Act 1992?
States if you are exercising a power under this act (41, 109, 110) you may use such force as is necessary in the circumstances
(do not use force to transport without ensuring that an assessment notice has been served on and explained to them)
