Define Child and young person
Child- person under age of 14years
Young person- A person of or over 14 but under 18.
What is the Paramount consideration when dealing with children and young people?
The wellbeing and best interests of the child or young person are the first and paramount consideration.

What is Section 48 of the OT act. How is it used?
CYP found unaccompanied:
1) when a child is FOUND UNACCOMPANIED by a parent, guardian, other person who usually cares for them
2) in a situation in which their PHYSICAL OR MENTAL is being or is likely to be impaired.
3) constable may use such force as may be reasonably necessary take the CYP
4) with their consent deliver into custody of parent, guardian, other person who usually cares
5) no consent or caregivers unwilling place the CYP into custody of Oranga Tamariki.
What is Section 42 of the OT act. How is it used?
Search without warrant- Action is required immediately because it is CRITICALLY NECESSARY to do so for protection of CYP.
Can enter without warrant and remove/detain the child or young person and place them in the custody of OT.
What are reporting requirements in relation to the use of powers?
1) when using 42- first entering and whenever asked produce evidence of identity and
2) state they are using section 42 of OT act.
3) Report to commissioner within 72 hours that you used this power by forwarding a notification in bulletin board.
When used you must advise OT immediately so they can arrange suitable placement.
What is section 10B of the Summary offences act 1981?
Aimed at whanau.
1) Being parent or guardian or caring for a child under 14
2) leaves that child
3) without making reasonable provisions for the supervision and care of the child.
4) for a time that is unreasonable or under conditions that are unreasonable.
What is ‘in need of care and protection’ mean?
Behaviours:
1) Parents/caregivers who abuse/ill treat their children or are unable or unwilling to look after them
2) Children or young persons who will not obey/listen their parents or willfully misbehaviour to a serious degree.
