P3 assault in the first
On the night the events occurred Jesse Caufield a local teen with a criminal record, struck Cooper Chase in the back of the head with the gun. The result of this violent blow was severe swelling , lacerations, and bruising to the face. This act of violence by Jesse Caufield is clearly assault in the first degree
P4 robbery
We have established that on the night in question Jesse Caufield brutally assaulted Cooper Chase when the he struck him in the head with a gun, Caufield also stole His/her car causing intense emotional distress for Chase. Officer Taylor Hernadez testified that the car was found within the vicinity of the Caufield residence and that Chase’s wet wallet was found inside the home of Jesse Caufield . The defense may have stated that the wallet was found in the parking lot but Cooper distinctively stated that he put his wallet down in the car. In her testimony Hernandez also has testified to the fact that Caufield fit the Clerks description of the youth whom Chase identified as his attacker. You also heard expert witness Wendall LaFave’s testimony, he stated that the fibers and dog hairs from Chase’s car matched the fibers on Caufield’s clothing from the previous night. Proving it was likely Jesse picked put he hairs while stealing Chase’s vehicle. You heard from the defense that the hairs found on Jesses clothing came from a dog in the park however it it is very unlikely l that Jesse and river encountered a dog they had never seen before that was of the exact breed as Chase’s dog.
P5 unauthorized use of a vehicle
Chase has testified that the defendant threw her/him out of the vehicle after striking him/ her on the head with the gun this is definitive proof that her vehicle was taken without her explicit content. In the testimony of Officer Hernadez you heard that the stolen car was found outside of the Caufield residence proof that it was taken by Jesse Caufield. Wendall LaFave testified to the fact that the fibers on Caufield where those from a 2009 Honda Civic which is the car owned by Chase and that the dog hairs on Caufield came from a dark grey Weimaraner the same dog that Chase owns. Lafaves testimony proves beyond a reasonable doubt that Jesse Caufield stole the car.
