Title VII of Civil Rights Act of 1964
- Forbids discrimination based on protected classes.
- Applies to companies w/ 15+ workers doing 20+ weeks per year
Title VII of Civil Rights Act of 1991
- Amends 1964 act
- Adds gender identity as protected
- Adds genetic information protection
- Extends to all employers
Section 1981 of Civil Rights Act of 1991
- Amends Civil Rights Act of 1866
- Protects contract relationship between employer and employee
- Covers bias against ethnic minorities
Age Discrimination in Employment Act (ADEA)
Prohibits discrimination against people over 40.
Americans w/ Disabilities Act (ADA) 1990
Cannot discriminate against a disabled person due to their disability. Must provide reasonable accommodations.
“Disability” defined by the impact on the person’s life.
Equal Pay Act of 1963 (EPA)
Equal pay regardless of sex
Fair Labor Standards Act (FLSA)
Minimum wage of $7.25 and overtime of 1.5x unless exempt. Defines who is exempt.
Employee Retirement Income Security Act (ERISA)
- Sets out rules for pension plans, retirement plans, etc.
- Establishes Pension Benefit Guaranty Corporation to guarantee pension payments.
Consumer Protection Act
Limits how much wage can be garnished
Federal Insurance Contribution Act (FICA)
Established FICA tax as insurance for SS and Medicare
Federal Unemployment Tax Act (FUTA)
Charges employers tax to pay for unemployment
National Labor Relations Act (NLRA)
Defines labor rights.
Immigration Reform and Control Act of 1986
Makes it illegal to employ illegal immigrants.
Consolidated Omnibus Budget Reconciliation Act (COBRA)
Requires employers to allow employees the option of staying on insurance when they leave.
Worker Adjustment and Retraining Notification Act (WARN)
Employers must give 60 days notice when shutting down a site causing 50+ full-time jobs to be lost.
Employee Polygraph Protection Act (EPPA)
Outlaws use of polygraph machines in most cases
Family and Medical Leave Act (FMLA)
Employers must allow up to 12 weeks of leave for medical reasons.
Rehabilitation Act of 1973
Prohibits federal contractors from discriminating against people w/ disabilities
Vietnam Era Veterans’ Readjustment Assistance Act of 1974
Requires federal contractors to hire and promote military veterans from the Vietnam War
Uniformed Services Employment and Reemployment Rights Act of 1994
Employers must allow long-standing employees to leave for military service and rehire them when they come back.
Consumer Credit Reporting Reform Act of 1996, Revising the Fair Credit Reporting Act (FCRA)
Can’t do a credit check without the person’s permission.
Personal Responsibility and Work Opportunity Reconciliation Act of 1996
Requires new hires be reported to state child support programs w/in 20 days.
Affordable Care Act of 2010
Requires employers to offer health care
Provides tax credit to small businesses to help pay for it
Requires everyone to have health insurance
