Dred scott Vs Sandford (1857)
Separation of powers becomes relevant. It is significant because it demonstrates that different States have different responses to the institution of Slavery. Slavery becomes a Compering political issue.
Reconstruction and Jim Crow (1865-18905)
The first reconstruction failed and provided a rise of Jim Crow laws and segregation. Established separate but equal policies. Disenfranchisement of African Americans. A rise in backlash leading to a push for voting rights.
Civil Liberties
Constitutional and legal protection from government interference.

The political policy of promoting or protecting the interest of “Native-born” over those of immigrants. Favored tough security measures on immigrants and making the process of Citizenship more difficult.

Due Process /Equal Protection Clauses
Due Process: 5th + 14th amendment, government must provide the due process of the law
Equal protection clause: 14th amendment, guarantees all citizens equal protection of the law
Wilmont Proviso
Assert that the land that the US acquired from Mexico Would not allow slavery. It fails but Shows a threat to balance
Dawes Act (1887)
used to break up tribal lands and set up reservations
The case for Reparations by Ta- Nehisi Coates
Coates Argues that the US is forever in debt to African Americans. Defines reparations as monetary payments towards marginalized groups. The failure of reconstruction provided for a possible solution to discrimination but it ended with an extreme countermovement.
Equal Rights Amendment
designed to guarantee legal rights to all regardless of Sex.
