(ii) SMJDX (diversity not disturbed)
(3) Can they be joined?
(i) Is there an alternative forum
(ii) what is the actual likelihood of prejudice
(iii) can the court avoid prejudice
*If not, they are ‘indispensable’ and case must be dismissed
