How is child support assessed?
- Look at the income of BOTH parties (new rule)
2. Add total incomes together and divide on a PRO RATE share
Who gets child support payments?
The parent whose child resides more than 50% of time with the parent (primary residential parent)
Parent A spends 70% of time with child while Parent B spends 30% of time. For child support purposes, what are the names given to both parents?
A: the primary residential parent (PRP)
B: the alternate residential parent (ARP)
How much time do courts allocate to alternate residential parents?
between 68-92 days
What happens when the alternate residential parent (ARP) spends less than 68 or more than 92 days with child?
child support is adjusted in accordance with a schedule based on the number of days
What if two parents spend an equal 50-50 amount of time with child?
the parent with the smaller child support obligation will be deemed the primary residential parent and will receive child support
How long does child support last?
until age 18 UNLESS child still in high school or disabled
If child is disabled, how long does child support continue?
until age 21
