Veto
An executive check against the legislative by giving the president the power to cancel out a bill.
Appointing a nominee
The president balances the executive and judicial by selecting people into positions for those branches.
Executive Actions
Executive checks and balances everyone by putting in temporary regulations or laws.
Overriding a Veto
Legislative check on the executive by overturning a veto by 2/3 vote in house and senate.
Confirming a nominee
Senate checks or balances the executive or judicial by a simple majority vote to confirm the appointed nominee.
Legislation of a law or amendment
Legislative check or balance on all parties by either a simple majority in the house and senate for law; or a 2/3 majority in house and senate with a ratification of ¾ states.
Impeachment
Legislative check on judicial and executive by a simple majority vote in house to bring impeachment and then it goes to the senate for a trial and if there is a 2/3 vote in senate for removal the official is removed. Extra credit: Andrew Johnson, Bill Clinton, and Donald Trump were impeached but not removed.
Bicameralism
Legislative check on itself, all one house needs to do is to not pass a bill in order to prevent a bill from passing on to the president, this is known as killing a bill.
Control of Court sessions and organization
Legislative check or balance on the judicial, control of court sessions is when the legislative adds or takes away time for the court to hear cases (Extra Credit: Such as the judiciary acts of the early 1800’s which prevented the court from meeting for a year); and control of court organization is when the legislative adds or removes courts to either aid or add to the stress of the court system.
Preemption under the Supremacy Clause
Check against the state by legislative in which the constitutionally passed laws are set as being supreme over the state’s laws.
Judicial Review
Judicial check on all federal cases and controversies set before the court to judge constitutionality and to interpret law.
10th amendment-
State check and balance by creating laws and regulations on all parties within its authority/jurisdiction.
Creating amendments
A state check or balance (that has never been used; Extra Credit info) that allows states to pass a federal amendment by a ¾ agreement between the states.
Holding Federal Government to its enumerated powers (10th amendment)
The state checks the federal government by suing and getting laws nullified as they were unconstitutional.
Elections
Check or Balance by checking the incumbent by voting for his opponent and a balance for voting for the incumbent.
