Sec. 12.02. CLASSIFICATION OF OFFENSES
Offenses are designated as felonies or misdemeanors
Sec. 12.03. CLASSIFICATION OF MISDEMEANORS
Class A misdemeanors;(2) Class B misdemeanors;(3) Class C misdemeanors.
An offense designated a misdemeanor in this code without specification as to punishment or category is a Class C misdemeanor.
Sec. 12.04. CLASSIFICATION OF FELONIES.
capital felonies;(2) felonies of the first degree;(3) felonies of the second degree;(4) felonies of the third degree; and(5) state jail felonies.
without specs is a state jail felony
Sec. 12.21. CLASS A MISDEMEANOR.
$4,000; jail for a term not to exceed one year; or both such fine and confinement.
Sec. 12.22. CLASS B MISDEMEANOR.
a fine not to exceed $2,000, jail for a term not to exceed 180 days, or both
Sec. 12.23. CLASS C MISDEMEANOR
fine not to exceed $500.
Sec. 12.31. CAPITAL FELONY
life, if the individual committed the offense when younger than 18 years of age; or life without parole, if the individual committed the offense when 18 years of age or older.
Sec. 12.32. FIRST DEGREE FELONY PUNISHMENT
99 years or less than 5 $10,000 fine
Sec. 12.33. SECOND DEGREE FELONY PUNISHMENT
20 years or less than 2 $10,000 fine
Sec. 12.34. THIRD DEGREE FELONY PUNISHMENT
10 years or less than 2 $10,000 fine
Sec. 12.35. STATE JAIL FELONY PUNISHMENT
2 years or less than 180 days $10,000 fine
Sec. 12.43. PENALTIES FOR REPEAT AND HABITUAL MISDEMEANOR OFFENDERS
Class A - be previously convicted of class A or state jail
fine is $4000 and jail no more than 1 year or less than 90 days.
Class B - bee convicted of Class A or B or any felony
fine$2000 jail no more than 180 no less than 30 days
Class C- any combo of offenses three times in 24 month
fine $200 jail not to exceed 180 days
Sec. 12.47. PENALTY IF OFFENSE COMMITTED BECAUSE OF BIAS OR PREJUDICE
If an affirmative finding under Article 42.014, Code of Criminal Procedure, is made in the trial of an offense other than a first degree felony or a Class A misdemeanor, the punishment for the offense is increased to the punishment prescribed for the next highest category of offense. If the offense is a Class A misdemeanor, the minimum term of confinement for the offense is increased to 180 days
