What is prohibited character inference?
judging an individual on basis of their general dispositions or propensities rather than on evidence that proves whether the individual actually committed the act in question on the occasion in question.
Evidence that tries to show a person has a particular type of character.
Character evidence.
What is character?
Needing evidence to show a person has or doesn’t have a particular personality type. Show that the individual is the kind of person more or less likely to engage in particular conduct.
Character evidence uses what type of argument?
Propensity argument -> invites trier of fact to infer that a person behaved in a certain way at a certain time because the behaviour is consistent with that person’s good or bad character or disposition, also known as propensity or disposition evidence.
