What is the rule about when the two different sigmas are used
The σ is used all the time apart from the end of a word, which is ς

What is hard breathing and what does it look like?
Hard breathing indicates an ‘h’ sound, and looks like a small ‘c’ over the top of the vowel which the ‘h’ sound is being used with.
What is smooth breathing and what does it look like?
Smooth breathing indicates the absence of the ‘h’ sound, and looks like a backwards ‘c’

Yes they count as part of the spelling for GCSE Greek (OCR)
