Sec. 1101.201.
Public Interest Information says that the commission must prepare information of public interest describing the functions of the commission and make that information available to the public and appropriate state agencies.
Sec. 1101.202.
Complaints states that the commission by rule will establish methods by which consumers and service recipients are notified of the name, mailing address, and telephone number of the commission for the purpose of directing a complaint to the commission.
Sec. 1101.203.
Complaint Information requires the commission to maintain a system to promptly and efficiently act on complaints filed with the commission. The commission must maintain a file on each complaint which must include:
⦁ Information relating to the parties to the complaint
⦁ The subject matter of the complaint
⦁ A summary of the results of the review or investigation of the complaint
⦁ The disposition of the complaint
Sec. 1101.204.
Complaint Investigation and Disposition explains the powers of the commission as it applies to investigating complaints
The commission will investigate the actions and records of a license holder if a person submits a signed, written complaint and the complaint and any evidence presented with the complaint provide reasonable cause for an investigation.
An investigation or other action against a person licensed under this chapter or Chapter 1102 may not be initiated on the basis of an anonymous complaint.
Sec. 1101.205.
Complaint Investigation of Certificate Holder states that the commission will investigate a signed complaint received by the commission that relates to an act of a certificate holder or a person required to hold a certificate under Subchapter K.
Sec. 1101.206.
Public Participation requires the commission to develop and implement policies that provide the public with a reasonable opportunity to appear before the commission and to speak on any issue under the commission’s jurisdiction.
The commission must prepare and maintain a written plan that describes how a person who does not speak English or who has a physical, mental, or developmental disability may be provided reasonable access to the commission’s programs.
