3 different laws related to equity in the workplace:
1) Employment Standards Act (Ontario)
2) Pay Equity Act (Ontario)
3) Employment Equity Act (federal)
A law that requires that women and men who are performing substantially the same work should be paid the same.
Employment Standards Act
A law that requires employers to provide equal pay for work of equal value, based on a proactive model of compliance.
Pay Equity Act
A law that requires federally regulated companies with 100 employees or more to implement employment equity programs in the workplace.
Employment Equity Act
A federal statute and therefore directly affects only federal organizations and federally regulated employers.
Employment Equity Act
ESA requirements for men and women to be paid the same:
1) If they are performing substantially the same kind of work
2) If they work in the same establishment
3) If their work requires the same skill, effort, and responsibilities
4) If the work if performed under similar working conditions
A concept that requires employers to compare totally different jobs and ascertain whether they are equal in value.
“Equal pay for work of equal value”
Steps in achieving pay equity:
1) Identify establishments
2) Determine job classes including the gender and job rate
3) Determine the value of job classes based on legislative requirements
4) Conduct comparisons for all female job classes
5) Identify and adjust the compensation
Provide employees with information about how pay equity was implemented and the results of the process.
Pay equity plans
Positions that have similar duties and responsibilities; similar qualifications; are filled by similar recruiting procedures.
Job classes
The highest rate of compensation for a job class.
Job rate
Circumstances where an employer should reevaluate jobs:
1) Where there are significant changes in job duties
2) Where a position is eliminated by combining 2 jobs
3) Where a temporary skill shortage ends
4) Where the employer introduces new technology that affects the value of the job
5) Where a sale or merger renders the pay equity plan obsolete
6) Where a union is certified to represent a group of employees
Administers and enforces the Pay Equity Act.
Pay Equity Commission of Ontario
2 bodies of the Pay Equity Commission:
1) Pay Equity Office
2) Pay Equity Hearings Tribunal
Receives and investigates complaints and attempts to bring about settlements.
