Employment Standards Act
Who is not covered under the ESR?
members of professional associations (doctors, lawyers etc.), persons receiving employment benefits while working under job creation projects, secondary school students working a work experience program authorized by the school, a baby sitter, persons recieving income assistance under the Employment and Assistance Act.
How many years must the ESR keep records?
four years
What are the requirements related to wage?
Employer must establish regular pay period and pay day* Minimum in BC is payment of all wages at least semi-monthly andwithin 8 days after the end of the pay period on before the regularpay day
What must wage statements include?
pay period, hours worked, each component of earnings, deductions, net amounts.
What types of deductions are allowed?
Statutory deductions (e.g. income tax)2. Court-ordered deductions (e.g. garnishing of wages)3. Authorized by a collective agreement4. With specific written authorization (i.e. Recovery of wageadvance or overpayment)
How quickly in BC does wage need to be delivered when employment ends?
If employer terminates, wages must be paid within 48 hours* If employee terminates, wages are due within 6 days
What are the minimum hours free of work in BC?
eight consecutive hours off work between shifts (s 36(2)); or * thirty-two consecutive hours off work every workweek, or else the employee is paid one and a half times the regular wage for time worked during the 32-hour period the employee should have been free from work (s 36(1)).
BC overtime pay rules?
In BC basic 8/40 rule
at minimum, employers must pay 1.5x the regular rate for time worked over 8 hours in a day whether or not the employee works 40 hours in the workweek.
Must pay 2x regular wage for every hour over 12 hours worked in a day
How much vacation pay is required?
At least equal to 4 percent of wages earned.
