what is a leasehold?
legal estate in land subject to a fixed time period

what is a freehold reversion?
A landlord will retain the legal interest after granting a lease
what is the condition on creating a sublease?
Must be for a shorter term than the original lease
what is a fixed term lease?
agreed maximum term at the start (usually not rented)
What is a period tenancy?
may last indefinitely (no end date)
keeps getting renewed at the end of the term (week to week, month to month, year to year)
a party must give notice to terminate
when does a lease need to be registered?
more than 7 years
what happens to a lease that is not registered but under 7 year?
overriding interest if formal requirements are met
how is a legal leasehold created?
by deed
when is a deed not necessary for a lease?
under 3 years
what happens if a lease is not registered and over 7 years
overriding interest cannot apply
equitable interest only
what are the characteristics of a lease?
Exclusive possession
Fixed duration
Completed correct formalities (deed)
What is exclusive possession?
Tenant has the right to control the use of the property e.g (who can enter/ who cannot)
can exclude others even the landlord
what is a licence?
personal right
no legal/ proprietary interest
grants permission to stay in the property
why is it better for a tenant to have a lease?
more protection e.g question rent charge
what is fixed duration?
fixed term agreed at the start = fixed for a maximum duration.
cannot exceed the landlords own term (if a new lease)
what is a covenant?
promise between a landlord and tenant that they will/ not do something
what are the landlord implied covenants?
quiet enjoyment - no interference
non-derogation from grant - cannot undermine tenancy for a specific purpose
repair - if not express implied against the landlord
what are implied convents for a tenant?
paying rent/ taxes
repairing (good condition - not significantly reduce value)
not committing waste (not permanently changing the land)
what rule applies for a breach of leasehold covenant between a landlord and tenant?
Privity of contract - only parties to the contract can sue or be sued
what rule applies to leasehold covenants if the successors of the freehold estate took ownership pre 1996?
successors not bound by every covenant only ones which touch and concern the land
Between the old landlord & tenant = privity of contract
Between the new landlord & tenant = privity of estate
if the successor of a freehold pre 1996 breached the terms who would be liable?
Old landlord STILL liable for any breach by the new landlord
unless can claim indemnity from new landlord
what rule applies to leasehold covenants if the successors of the freehold estate took ownership post 1996?
Removes ongoing liability from the original landlord
Must write to tenant
Tenant must agree or no reply within 4 weeks - automatic release.
if the successor of a freehold post 1996 breached the terms who would be liable?
the new landlord
if the new landlord goes bankrupt the tenant will bear the cost of the breach
