Tenant obligations?
▶ Pay the agreed on rent at the agreed on time.
▶ Use the property with diligence
▶ Can’t change the form or usage of the rental (including the locks)
▶ Keep the property clean
▶ Respect the law when it comes to the safety and cleanliness of the property
▶ Don’t disrupt the quietude of other renters in the building
▶ Accept urgent and necessary repairs.
(must be same as beginning of lease)
Landlord rights/obligations?
▶ At the agreed on date, the landlord must deliver the apartment in good standing of repairs, of living condition and of cleanliness.
▶ He must maintain the apartment in good living conditions.
▶ He must guarantee that the apartment can be used for it’s normal purpose and he must maintain it for the purpose for the whole length of the lease.
▶ He must do all the necessary repairs, apart from those which should be
made by the tenant.
▶ He must insure that the number of occupant respects the normal
conditions of comfort and cleanliness.
▶ He must not change the form or purpose of the apartment.
Ideal renting budget % ?
Ideally it should not be more than 25%of your gross revenue.

- determine type and location based on your needs/revenues
- speak to ppl
- look at newspapers/internet/bulletin boards
What is a Signature of a request of apartment (or conditional lease)?
It is a request that does not guarantee the apartment but forces you to take on the lease if the landlord agrees to rent it to you.
Is the lease a contract?
Yes
How soon must the landlord give you a copy of the lease after signing it?
within 10 days of signing it.
What can the landlord ask you after signing lease?
First month of rent $$ nothing else
Do you have the right to know the lowest paid price for the apartment you plan on renting in the 12 preceding months?
Yes and it should be found on the lease (section G) unless residence is newer than 5yrs
Is a tenant an occupant?
Not necessarily
Types of roommates?
- Joint obligations (by default) (individudal paying responsibility)
- Solidary obligations (each roommate entirely responsible (might need to pay for other person’s rent))
Can you be kicked out if your roommate does not pay (joint-obligation)
Yes, though you just won’t be sued.
What is subleasing/subletting?
Tenant finds someone else to live in the place they are renting (original tenant still responsible for paying owner etc). Landlord must accept subletting sauf exception
When does landlord need to notify you of end of current lease for a 12+ month lease?
3-6 months before (you must reply within 1 month, or else just considered accepted and renewed with new condition.
What are you options when a lease comes to an end and new conditions arrive?
- Accept the changes (by default)
- Refuse the changes and move
- Refuse but renew your lease (negociate or landlord goes to Regie to get maximum allowed rent increase (only if more than 5 year old building)
Who is responsible for urgent/major repairs?
Landlord (if uncooperative, tenant must verify if urgent or not with Regie)
Tenant is responsible for minor repairs
For what reasons can you get landlord repossess?
- live there himself
- parents or children will live there
- other relative/spouse who wants to live there and who relies on them (the landlord) as main support
- ex-spouse who relies on landlord as main support
Assignment of lease is?
permanently transferring lease to someone else. You are responsible for doing all steps to find/verify tenant.
Landlord must agree if:
- allocated low-retal or senior residence housing
- cant occupy bc handicap
- domestic violence/sexual
