Rights for accused in 5th and 6th amendments

- Habeas Corpus
A court order directing officials holding a prisoner to show cause why he should not be released - Ex Post Facto Laws
Banned criminal laws that provide for punishment of crime committed before law passed - Grand Jury
Prosecutor must obtain a “true bill of indictment” from grand jury - Double Jeopardy
A person may not be tried more than once for the same crime. An appeal is not a retrial. - Speedy and Public Trial
Accused person - prompt trial (100 days from being charged with a crime)
Public trial protection for defendant (not media) - Trial by Jury
Impartial jury
May waive right to jury and be tried by judge

Search Warrant?
A
Police must, except in particular cases, possess a warrant (must be issued by a judge) with probable cause to make an arrest or search for evidence

Exclusionary Rule?
A
Evidence obtained as the result of an illegal act by the police cannot be used to prosecute the person from who it was seized

Due Process of Law?
A
Gov may not deprive any person of life, liberty or property without due process of law
Substantive due process: laws must be fair
Procedural due process: enforcement must be fair
