Justified Discrimination
Is permitted and even encourage if the employer has good reason for treatment

Employee quality may cause an employer to treat him or her favor
Protected Classes
The following persons are listed and associated with the protected class
Race and Color
Includes all person who are not white, african American, Asian, Filipinos, Hispanic, native Americans, and other are members of this protected class
Gender
Sexual harassment is illegal, employers may not discriminate against females or makes based on gender
Pregnancy
Can’t discriminate if a person is pregnant or plans on having a family
Age
People who are over 40 are protected against discrimination
Religion
People are protected regarding religious beliefs, this could include everything
Disability
Physically and mentally disabled have limited protection against discrimination
National Origin
Those who do not speak English or who are not citizens of the U.S. Are protected to a limited extent
Against unjustified conditions of employment
Illegal if discrimination is displayed in pay, promotions, training, overtime, educational opportunies, travel requirements, shift rotations.
Governing most employees
Almost all employers except some small business are subject to follow federal employment discrimination laws
Title IV of the Civil Rights of 1964
Forbids employers, employment agencies and unions from discriminating in hiring, paying, training, promoting, or discharging employees on the basis of race, color, religion, national origin of sex
EEOC
Gave authority to investigate and settle complaints of the job discrimination
Affirmative Action Plan
Stated that if there was employer discrimination in the past, the courts may mandate this plan to bring up percentage of minorities and women in the work place
Equal pay act of 1963
Prohibits wage discrimination on the basis of gender, must possess the same the skill, effort, responsibility required on the job
Age discrimination in employment act of 1967
Forbids discrimination against workers over the age of 40
Employment Discrimination
Defined as treating individuals differently on the basis of race, color, gender, pregnancy, age, religion, disability, and national origin
Unequal treatment
Means that an employer intentionally treats members of a protected class less favorably than other employees
Disparate
Another name for unequal treatment
Business necessity
Means that the employers action were meant to advance the business rather than create unjustified discrimination
Bond Fide Occupation
Discrimination must truly be essential to the business
Seniority
Bona fide seniority system is one that rewards employees based on length of employment
Pretexts
Employers sometimes assert ness its of BFOQ as a pretext or cover for discrimination
Neutral on its face
Means that a company policy stating makes no reference to a protected class
Quid Pro Quo
When a favorable term of employment (raise) is exchanged for favors
