What is a Tort?
A
A wrongful act that results in injury to one person to another.

When does a Tort occurs?
A
When someone experiences injury because of another’s fault to take care.

What are the 4 D’s of Negligence?
A
Duty of Care, Derelict, Direct Cause and Damage.

What is Duty of Care?
A
The MA must meet a high standard of care.

What is Derelict?
A
When the MA fails to meet the standard of care and a court may find to be Derelict (neglectful of your duties).

What is Direct Cause?
A
When the MA’s dereliction caused am injury.

What is Damage?
A
The injury came from the MA’s neglectful and not form some other source.
