Alternative Dispute Resolution
A newer problem solving court involving arbitration and mediation
Adversarial System
Exhibits, evidence, and witnesses are assembled by representatives of one side or the other to convince the fact that their side’s viewpoint is the truthful one.
Inquisitorial Approach
The judge has more control over the proceedings in Europe (not Great Britain)
Black Letter Law
“Law on the books”
The law as set down by our founding fathers in the Constitution, as written by legislators, and as interpreted by judges .
Euthanasia
The act of killing an individual for reasons that are considered merciful
Intention
Showing that the suspected individual not merely thought about the crime but actually tried to accomplish it. Should be punished to the same degree as the successful offender
Attribution Theory
How people assign causes, including intentions, to the behavior of others and themselves
Distributive Justice Model
A focus on the fairness of the outcome in a legal dispute
Procedural Justice Model
If individuals view the procedures of dispute resolution or decision-making as fair, then they will view the outcome as just, regardless of whether it favors them or not
