Substantive law
Law that defines the duties owed by one person to another.
Procedural law
Law that defines the rules and steps that must be followed in a lawsuit.
Duty
In tort law, due care owed by one person to another.
Proximate cause
In tort law, the cause-and-effect relationship that must be established to prove that the conduct in question was the substantial cause of the injury in question.
Leading question
Question phrased in such a manner as to suggest the desired answer.
Contingent fee
Legal fee for representation based on a percentage of the award won by the plaintiff and allowing for no fee if the plaintiff does not win.
Statute of Limitations
Law stating the time limit in which an action must be filed. If the time limit is not met, the defendant has a defense to the action, and the case will be dismissed.
