Two types of dangerous charges
- Carrying a per se dangerous weapon
- Possession of a dangerous weapon during a BOP or having a warrant
Definition of Carrying
Carried on his person or under control in their vehicle
Knives that are covered under dangerous weapons
Stiletto, Dagger, knife being drawn in a locked position, propelled knife, Dirk knife, double edged, automatic spring handle that releases a blade
Automatic spring handle knives must have a blade of at least
1.5 inches
What is not considered a dangerous weapon anymore
Switchblades
Martial Arts weapons that are covered by dangerous weapons
Nanchaku, Zoobow (klackers), Kung Fu Sticks, metal or plastic connected to rope, shruiken (star throwing), leather arm bands, CESTUS
Random items that are covered by dangerous weapons (per se)
Slungshot, blow gun, blackjack, metal knuckles, any knuckles of any hard substance
What does the defendant have to be arrest for to be charged with this crime with possession of a weapon (non per se)
only warrant arrest
Are firearms or other per se weapons covered by the BOP or warrant version of this crime
