Tort
a breach of obligation causing harm to a person.
Plaintiff
civil case injured party that brings lawsuit/legal action.
Judgment
a courts decision in a civil case
Defendant
the person who the claim is made against/person being sued.
Damages
money asked for or court ordered for the plaintiff
liable
legally responsible
remedy
what is done to compensate injury or enforce some right
liability
the legal responsibility to do or do not do something.
settlement
a mutual agreement between both party’s to come to a solution before going to court.
common law
a system in which court decides legal principals and rules of law.
precedent
a court decision that will guide legal cases in the future.
status
written laws enacted by legislatures
intentional wrong
action taken to deliberately harm another person or their property.
negligence
the failure to execute a reasonable amount of care in either doing or not doing something, resulting in the harm to injury to another person
strict liability
the legal responsibility for damage or injury even if you are not negligent
civil law
all law that doesn’t involve criminal matters such as tort, contract law, private rights, groups, or businesses
standard of proof
the level of certainty and degree of evidence needed to establish proof in civil and criminal court.
preponderance of evidence
usually the standard of proof used in a civil suit. Proof needed for the party to win the lawsuit
deep pockets
a description of a person or group of people best able to pay for damages.(more likely to be sued in a tort case)
immune
exempt from penalties and punishments.
waive
to give up a right/privilege voluntarily
class action
a lawsuit brought by one person or more on behalf of larger group
Contingency Fee
the fee paid to an attorney depending on the percentage of money they money
liability insurance
type coverage or insurance that pays for other peoples damaged property
