When would it be necessary for an owner to request a variance?
When he needs permission to vary from strict compliance with all or part of a zoning code because compliance would force undue hardship on the owner. Two conditions:
Show a hardship that will be caused by compliance (not economic or personal hardship). Hardship must be related to the property’s use. AND
Zoning board of adjustment must judge all variance requests by the same criteria.
No one has a right to a variance.
What is a Development of Regional Impact (DRI)?
Any development that, because of its character, magnitude, or location, would have a substantial effect on the health, safety, or welfare of citizens of more than one county. The state is involved in overseeing, planning, and supervising the development of DRI’s.
What is a PUD?
Larger than traditional subdivision Usually has mixed uses Maximizes open spaces Higher density Lots of apartments or townhouses Clusters of dwellings Different areas for dwellings, offices and retail
How is a subdivision plat map used and who is it submitted to?
A map that shows the location of all lots, infrastructure and amenities in a subdivision
Submitted to the Planning and Zoning Board for approval.
What is the purpose of impact fees?
To fund major off-site infrastructure expansion that serves the community at large as well as the subdivision residents.
What are the cancellation provisions for selling subdivided land?
If more than 25 lots in the subdivision, must provide each purchaser with a property report before signing the contract. If received prior to signing contract, can cancel contract within 7 days. If not provided, can cancel up to 2 years after date of signing.
