Sheppard v. Maxwell
1956- based on the movie The Fugitive. This case says that the media can make it impossible to receive a fair trial.
Nebraska Press Assoc. v. Stuart
1976- this case created the 3 questions when determining is a gag order is effective.
- has there been intense and pervasive publicity that likely will affect the trial?
- are there no other ways to do it besides a gag order?
- Is the gag order going to be effective?
Gentile v. State Bar of Nevada
1991- its permissible to punish an attorney who makes comments that may “substantially” influence the trial.
Estes v. Texas
1965- Cameras in the courtroom, ultimately decided that Estes did not receive a fair trial.
Chandler v. Florida
1981- The presence of cameras in the courtroom doesn’t mean you’re trial has been compromised.
