Chapter 15 - Customary law and the RCLSA Flashcards
Family property or general property
The family property does not belong to a specific house but jointly to all the family members. It includes the property the husband inherited from his mother’s house, acquired by his own efforts and labour, and land allotted by traditional authority
House property
House property is generally relevant in polygynous marriages where each wife constitutes a house. It is allotments made to the house by the family head and anything obtained by, or through, a member of that house
Personal property
Personal property is the property of a personal nature that belongs to a specific person, such as clothing and jewellery. Generally, the owner of the personal property was free to dispose of it in a will.
