roach Vs electoral commission 2007
- in 2006 howard gov passed legislation to amment the cth electoral act 1918, he changed it so people in prision do not vote at all
- before this ammendment, people who were serving time 3 years or longer could not vote
- this was a ‘voter suppression’ attempt
- roach claimed it infinged constitution
- the case went to the high court to interpret and give meaning, they had to interpret section 7 and 24
- S7 - senate chosen directly by the people
- S24 - HOR chosen directly by the people
- the prisioners are still people and were disenfranchised
- high court decided if prisioners were people
- HC found that the blanket voting ban for all prisoners was unconstitutional and the right to vote can only be limited for substantial reasoning
- the ban was disproportonite
- and the high court invalidated the law - quashed
- parliament can only take away peoples right to vote if it is strengthening the democracy - such as giving 0-16 no right to vote
